Although the territorial concept is fundamental to the taxation of profits in Hong Kong, the treatment of source of profits remains one of the most contentious tax issues for companies based here. In line with changes around the world, which includes the implementation of the various standards under the OECD's BEPS Action Plan such as a transfer pricing regulatory regime, the Inland Revenue Department (IRD) has deployed more resources to examine certain transactions such as offshore claims and related transfer pricing arrangements. IRD officers have also taken a more stringent approach to reviewing profits tax issues, which could lead to protracted tax disputes in some cases.

The Chamber has invited Emily Chak and Philip Hung from PwC Hong Kong to share real-life cases on effective ways to deal with IRD assessments and investigations with special emphasis on offshore claims.
