Hong Kong is on the cusp of enhancing its copyright regime – with the anticipated introduction of the Copyright Ordinance amendment bill into the Legislative Council in 2025 (including the introduction of a Text and Data Mining (TDM) exception).

What does it mean for Hong Kong’s Artificial Intelligence (AI) development and relevant businesses, as our city moves towards becoming a global innovation & technology powerhouse?

The Hong Kong Chamber of Commerce (HKGCC), in partnership with The American Chamber of Commerce (AmCham) and Hong Kong Computer Society (HKCS), are pleased to launch a seminar that delves into these latest regulatory developments, implications for businesses and the road ahead.

We are delighted to have invited Andy Lam, Deputy Secretary for Commerce & Economic Development, as well as Thomas Tsang, Deputy Director of Intellectual Property to share the Government’s roadmap for copyright reform. Join us also for a lively discussion, where Fred Sheu, Vice Chair of HKGCC Innovation, Data and Communication Committee and Bryan Ha, Co-Chair of AmCham Innovation and Technology Committee will jointly moderate a panel of experts - Ling Ho, Partner, Clifford Chance; Crystal Fok, HKCS AI Specialist Group Exco Member; and Director of AI Applications at Cyberport; and Timothy Tam, Associate Director, CEO Office, Hong Kong Science and Technology Parks Corporation - to unpack the potential of the city’s upcoming copyright reform to fuel AI development, exploring the delicate balance between fostering innovation and safeguarding intellectual property (IP), as well as the impact on I&T industries, copyright owners, and users alike.

Andy Lam, Deputy Secretary for Commerce & Economic Development

Andy Lam joined the Administrative Service of the HKSAR Government in 2002.  He has served in various policy bureaux and departments, including the Chief Secretary for Administration’s Office; the then Environment, Transport and Works Bureau; the Hong Kong Economic and Trade Office, London; the Commerce and Economic Development Bureau; the Information Services Department; the then Transport and Housing Bureau; the Financial Services and the Treasury Bureau; and the Home Affairs Department. 

He took up the post of Deputy Secretary for Commerce and Economic Development in October 2023, responsible for policies relating to intellectual property trading and protection, trade facilitation, the Trade Single Window, etc.

 

Thomas Tsang, Deputy Director of Intellectual Property

Thomas Tsang was admitted as a Solicitor of the High Court of the Hong Kong Special Administrative Region (“HKSAR”) in 2000, and then commenced his private practice specialized in intellectual property (“IP”) law.  In 2008, he joined the Intellectual Property Department of the HKSAR Government.  Since then, he has been tasked with handling legal and policy issues pertinent to different IP areas covering copyright, trademark and patent. 

In 2022, he assumed his present position with major duties covering rendering advice on policy and legislative matters concerning IP, monitoring the provision of legal advice to HKSAR Government bureaux and departments on civil IP matters, overseeing the operations of the Trade Marks, Patents and Designs Registries, and monitoring registry hearings and appeal cases to the court etc. Mr Tsang also participates in local, regional and international IP forums/conferences, as well as public education activities to promote IP issues covering initiatives to enhance IP trading and commercialisation.

Crystal Fok, Exco Member of Artificial Intelligence Specialist Group, Hong Kong Computer Society and Director of AI Applications, Hong Kong Cyberport Management Company Limited

Crystal Fok is the Director of AI Applications at Hong Kong Cyberport Management Company Limited, where she leads initiatives to advance AI development. Her focus is on building a comprehensive AI ecosystem and enhancing infrastructure support to drive innovation in the field.

Previously, Fok was the Head of the Digital Service Hub at Hong Kong Science and Technology Parks Corporation (HKSTP). In this capacity, she directed various innovation and technology initiatives aimed at promoting technology adoption across industries and enabling cross-industry data collaboration.

Fok earned her PhD in Automation and Computer-Aided Engineering from the Chinese University of Hong Kong (CUHK). Her research interests include artificial intelligence, robotic arm manipulation, micro-robotics, MEMS, and micro-optics

Ling Ho, Partner, Clifford Chance

Ling Ho has spent over 30 years advising clients on intellectual property related matters in the Greater China region. Her expertise covers the full spread of contentious and non-contentious IP issues. She is the head of the Hong Kong Litigation and Dispute Resolution practice and is a core member of the firm's global Tech Group with particular focus on IP, cyber, tech disputes and risk management.

Ling has extensive trial, deal and strategic counselling experience, and has acted in leading cases in the fields of trademarks, patents, copyright, designs to confidential information.

Ling is regularly involved in negotiating and drafting brand usage, technology transfer and other IP related collaboration agreements for clients investing into Asia markets.

Ling's practice also spans arbitration, commercial litigation, cyber, data privacy, defamation as well as product liability claims. Her clients range from multinational corporations and government agencies to leading businesses and individuals in the region, across a broad spectrum of industries including healthcare, technology, media, consumer goods and retail, financial services and leisure.

Timothy Tam, Associate Director, CEO Office, Hong Kong Science and Technology Parks Corporation

Timothy Tam is a regional corporate affairs and strategy leader building public-private partnerships to deliver business and social impact for over 15 years. He has led strategic planning, operational excellence and the management of key development projects at the Hong Kong Science and Technology Parks Corporation since February 2024. As a member of Google Hong Kong’s Senior Management Committee and Google’s policy representative in Hong Kong for five years, Timothy managed the company’s interactions and partnerships with governmental, regulatory, business, and civil society stakeholders amidst a complex policy and geopolitical environment. Timothy formulated and executed Google and YouTube’s cross-functional strategies and programmes to support Hong Kong’s economic goals and capture business opportunities. He was also the interim Chief of Staff for Google’s Asia-Pacific Government Affairs and Public Policy team on top of his leadership role in Hong Kong.

Timothy’s wide-ranging managerial experience at Google, the Hong Kong Government, the Hong Kong Jockey Club, and industry associations enabled him to drive large-scale, cross-sectoral projects, build high-performing teams with diverse backgrounds, and help organisations navigate policy and public affairs challenges. Timothy has been a Vice Chairman of the Innovation, Data and Communication Committee of the Hong Kong General Chamber of Commerce since 2020. He holds a master's degree in public administration and a bachelor's degree in international business and Global Management from the University of Hong Kong.

Fred Sheu, Vice Chairman, HKGCC Innovation, Data and Communication Committee

As National Technology Officer at Microsoft Hong Kong, Fred Sheu supports policy decision and delivers technologically relevant solutions into Hong Kong market. Fred’s main objectives are to align IT value propositions to public policies in such areas as healthcare, education, the environment, and local social and economic development; and to promote a digital agenda in top policy areas, including innovation, AI, security and privacy, technology neutrality, accessibility, and interoperability.

Fred is an active veteran in Hong Kong ICT industry, he serves in councils of Hong Kong Computer Society (HKCS), itSMF Hong Kong Chapter and the Hong Kong Information Technology Federation (HKITF). Other public services roles that Mr. Fred Sheu is currently serving include Member of Innovation and Technology Training Board (ITBB) of VTC and Convener of its IT sub-committee, Member of OGCIO’s Advisory Committee of the “IT Innovation Lab in Schools” program, Vice Chairman of Innovation, Data and Communication Committee of Hong Kong General Chamber of Commerce, and Member of sub-group on Talent Development of HKSAR Government’s Digital Economy Development Committee.

Bryan Ha, Co-chair, AmCham Innovation and Technology Committee

Bryan Ha leads the public policy work of AWS in Hong Kong, with overall responsibility for policy, regulatory matters and government affairs in Hong Kong. Before joining AWS in late 2022, Bryan was a directorate officer in the Government of the Hong Kong Special Administrative Region. During his 18-year government career, Bryan formulated and implemented policies relating to external affairs, innovation and technology, public finance, elderly care, vocational education, and district administration, including postings in Berlin and Washington D.C.

Bryan studied and worked in the U.K. and Germany from 1995 to 2004. He holds a Master of Engineering in Computing (first class) from Imperial College of Science, Technology and Medicine, and worked as a software designer/engineer at Deutsche Börse and Nortel Networks. Since 2025, Bryan serves on the Board of AmCham Hong Kong. He is also a Member of the Institution of Engineering and Technology, and a Full Member of the Hong Kong Computer Society.
