Hong Kong's battle with the fifth and most serious wave of the pandemic earlier this year has seen the roll out of various measures to curtail its spread. These included initiatives such as the "Vaccine Pass" scheme – which is in the third stage of implementation as of 31 May – governing access for designated premises.

More recently, changes have been made to the Employment Ordinance (Cap. 57) with the passing of the Employment (Amendment) Bill 2022, to address employment issues associated with Covid-19 prevention measures implemented by the Government. Noteworthy developments arising from such legislative amendments include empowering employers to dismiss an employee for refusing to be vaccinated in the absence of a medical waiver.

Join us on 28 July, when Michael Szeto, Partner from ONC Lawyers, will detail the key changes to Hong Kong's employment legislation, as well as its implications for employers and employees. He will also discuss such practical issues as:

•   Can employers require employees to take tests or be vaccinated?
•   Can employers dismiss unvaccinated employees?
•   Can employers dismiss employees who cannot come into the office because of mandatory lockdowns or compulsory home quarantine?
•   Can employees refuse to go to work in fear of contracting COVID-19? Can employers dismiss the employees concerned?
•   Can employees insist on "Work From Home"? Can employees refuse to attend work?
•   Can employers deduct employees' wages for absence from work?

Michael Szeto, Partner, ONC Lawyers

Michael is a litigation partner of ONC Lawyers and heads the firm's Employment practice. He has over 20 years of experience in handling complex commercial dispute resolution, shareholders’ and joint venture disputes, bankruptcy and insolvency matters, debt recovery and mortgagee actions. He also routinely deals with regulatory actions and compliance matters under the Securities and Futures Ordinance, the Hong Kong listing rules and anti-money laundering laws and guidelines. 

On the employment side, Michael frequently advises on various contentious and non-contentious employment matters, covering contract reviews, termination disputes, injunctive relief, discrimination and harassment claims, data privacy matters, as well as advice on matters relating to team moves, remuneration packages and employee incentive schemes. He is a frequent author of employment articles in industry publications and presenter to legal and human resource professionals.
