What's On

As of March 22, 2024, China has a new set of rules in respect of the outbound transfer of data from China, which was a long-awaited, welcoming relaxation of its former regime and multinational and Hong Kong companies which do business in or with China should examine and adjust their China data strategies accordingly.

Under the former regime, all outbound transfer of personal information from China, including intercompany transfer to headquarters outside of China, must proceed using one of the following three mechanisms:

- government approval (security assessment)
- certification that the outbound transfer may proceed
- entering into a standard contract (Chinese SCCs) prepared and issued by the Chinese government

The new China data rules, including Regulation for Promoting and Standardizing Cross-border Data Flow, Guidelines for Declaration of Data Transfer Security Assessment (Second Edition) and Guidelines for Filing Standard Contracts for the Transfer of Personal Information (Second Edition), were issued on March 22, 2024 and went into effective for the whole of China immediately.

Our seminar on 10 May, led by Chiang Ling Li, Partner at Tiang & Partners, will discuss the new requirements and is designed to enhance your understanding of China's latest data protection regulations and minimize any risk of breaching the laws.

Li has focused on Data, Cybersecurity, and Intellectual Property law since 1994. She has been at the forefront of the law, from obtaining approvals for outbound transfer of data from China to handling data breaches for multinational companies.

Li recently assisted an Asian government authority with data issues relating to the establishment of a data exchange. She has advised a Middle Eastern government on putting in place a cybersecurity and data regulatory framework for the country, and assisted with the legal analysis relating to the possible free flow of data within the Greater Bay Area. Besides aiding multinational companies with the security assessment by China data regulators for the outbound transfer of data, she has also advised a global law firm on data protection issues as well as a US alliance on data vulnerability issues, and helped a quasi-government authority and a university to put in place data governance frameworks for data from multiple jurisdictions (including the United Kingdom, Germany, France, China, Taiwan, Korea, Singapore, Australia, Japan, Canada and the United States).
