Cross-border income tax issues have become more complex in recent years due to changes in Individual Income Tax laws in both Hong Kong and Mainland China. These undeniably affect expats (including Hong Kong and Macao residents) working in the Mainland.

Another issue for expat workers is that preferential tax treatments on fringe benefits such as housing rental, language training and children's tuition in the Mainland are due to expire at the end of this year.

Whether this preferential policy will be extended beyond 2021 is a hot topic, as it will have an impact on the Mainland's attractiveness to expats as a place to work. In the meantime, some local governments and tax bureaus have launched their own tax subsidies to attract talent to work in specific cities.

How should businesses deal with these developments? And how can they structure their employment terms to attract and retain talent?
