A New Modus Operandi: Countering Cross-Boundary Crimes in the Digital Era

Rapid advancements in technology and the expansion of the internet have fostered the proliferation of a range of cyber-induced and cyber-dependant crimes in the digital economy – a big challenge for the global business environment and law enforcement.

At a seminar on 11 May, Dominic Wai, Partner, ONC Lawyers and Michael Kwan, Honorary Lecturer, Department of Computer Science, HKU and HKU Space, discussed the latest developments in cross-boundary crimes in the digital age – including money-laundering, smuggling and crypto scams, as well as how innovative technologies such as blockchain and big data analysis could aid companies and law enforcement authorities in combatting such illicit activity. Speakers also detailed the criminal and civil remedies to counter such crimes, with the former including the use of such existing legislation as the Telecommunications Ordinance (Cap 106) or the Crimes Ordinance (Cap 200) to criminalise the offence, and the latter including the use of third party disclosure orders to seek access to or retrieve data.

Employment (Amendment) Ordinance 2022 in the Wake of Covid-19

Hong Kong’s Employment Ordinance was recently updated to address issues arising from the Government’s Covid-19 prevention measures.

At a webinar on 28 July, Michael Szeto, Partner at ONC Lawyers, detailed the key developments arising from the legislative amendments. For example, employers now have the right to dismiss an employee for refusing to be vaccinated in the absence of a medical waiver. He also touched on the practical implications of the new law for employers and employees, including whether employers can require employees to conduct tests or be vaccinated, whether employers can dismiss unvaccinated employees and whether employees can insist on working from home.

Tightening the Belt: Employment Law Issues Regarding Business Downsizing in an Economic Downturn

Key employment issues he touched on included whether employers can request employees to take no-pay leave, dismiss employees without reason, or reduce wages or change contractual terms.

Is It Safe to Moonlight Now? And other recent issues on bribery and corruption laws in Hong Kong

Dominic Wai, Partner of ONC Lawyers, spoke about exemplary court cases involving an employee committing a criminal offence by breaching Section 9 of the Prevention of Bribery Ordinance for having a part-time job. He advised that employees, being an agent of their employer, should seek informed consent from their employer whenever in doubt and professional legal advice if needed.
