A New Modus Operandi: Countering Cross-Boundary Crimes in the Digital Era

Rapid advancements in technology and the expansion of the internet have fostered the proliferation of a range of cyber-induced and cyber-dependant crimes in the digital economy – a big challenge for the global business environment and law enforcement.

At a seminar on 11 May, Dominic Wai, Partner, ONC Lawyers and Michael Kwan, Honorary Lecturer, Department of Computer Science, HKU and HKU Space, discussed the latest developments in cross-boundary crimes in the digital age – including money-laundering, smuggling and crypto scams, as well as how innovative technologies such as blockchain and big data analysis could aid companies and law enforcement authorities in combatting such illicit activity. Speakers also detailed the criminal and civil remedies to counter such crimes, with the former including the use of such existing legislation as the Telecommunications Ordinance (Cap 106) or the Crimes Ordinance (Cap 200) to criminalise the offence, and the latter including the use of third party disclosure orders to seek access to or retrieve data.
