Latest Regulations for Outbound Transfer of Data from China
Chiang Ling Li, Partner of Tiang & Partners, and Kok Tin Gan, Partner of PwC Hong Kong, updated members at a webinar on 30 August about the new rules for transferring data outside of Mainland China.
In addition to discussing the specific regulatory requirements for different data processors and in different scenarios, the speakers explained in detail the permissible ways to enable the outbound transfer of data, including security assessment, certification and adopting a standard contract clause. The liabilities for non-compliance with these rules were also discussed, illustrated by a number of recent high-profile case studies.
The speakers also answered a range of members’ questions relating to the legality of transferring employee information to headquarters in foreign countries, the ideal cloud server location, as well as operational changes made by companies.
