Personal Information Protection Law: Impact on Virtual Banks and Online Brokers

Wilson Yan and Jihong Chen, Advisors of Gold Partners Holdings Ltd, spoke at a seminar on 12 January about the impact of China’s new Personal Information Protection Law on virtual banks and online brokers. They also discussed the regulatory obligations of the new law, which came into force on 1 November 2021.

Yan suggested several risk prevention measures including pre-enforcement study of the new law, establishing a cross-border data compliance risk prevention team, and monitoring the use of personal information by algorithms.

Chen explained that the Mainland was very strict in its protection of personal information. For example, network platform operators are regulated by the "Measures for Cybersecurity Review" if they are engaged in data-processing activities in internet services, even if they do not provide services for bilateral or multilateral entities.
