Highlights of Employer Duties

Please note that this list is only a summary of the most important duties under the MPF legislation and should not be treated as an exhaustive list of your duties.

Item Relevant Section of MPF Ordinance / Regulation Short Description of the Relevant Duty or Requirement
1. Participation Certificate Regulation - 124(3) Display the Participation Certificate issued by the Mandatory Provident Fund Schemes Authority at a prominent location in the office.
2. Enrolment Ordinance - 7(1) Arrange for all employees who have been employed for 60 days or more to join a registered MPF scheme.
3. Contributions Regulation - 122(2) Calculate individual employees relevant income and the amount of contribution for each contribution period.
Ordinance -7A(2)(b) Deduct 5% from the employees relevant income and also any voluntary contributions as stipulated by the employees.
Ordinance -7 A(2)(a) Pay employers contributions out of the employers own funds.
Regulation - 123 Pay contributions together with a Remittance Statement to the trustee within 10 calendar days after the last day of contribution period.  The remittance statement must include:
  • The amount of relevant income of each employee
  • The amount of employers mandatory contributions
  • The amount of employees mandatory contributions
  • The amount of employers voluntary contributions, if any
  • The amount of employees voluntary contributions, if any
Regulation - 139 Provide employees with Monthly Pay Records within 7 working days after the contribution payment. The Pay Records must detail the amount of relevant income, mandatory and voluntary contributions by employers and employees, and the date of remittance to the Trustee.
Regulation - 141 Answer employees inquiries about contributions.
4. Cessation of Employment Regulation -146(8) When an employee ceases employment, assist the employee to complete the relevant form to transfer the accrued benefits to another registered scheme.

Advise the Trustee of such cessation within 30 days after cessation.

5. Record Keeping Regulation 140(1)(2)



Maintain the following records about each payment of relevant income to employees for at least 6 months after the payment is made:
  • the total amount of each payment
  • the respective amount of the items making up each payment
  • the date on which each payment is made
Regulation 140(3)(4) Maintain the following employees records for at least 6 months after the employees employment ceases:
  • name and correspondence address of the employee
  • the date on which the employees employment began
  • the notice of election (if any) to join a MPF scheme
  • the notice (if any) given by the employee authorizing the employer to deduct voluntary contributions from the relevant income of the employee for payment to the registered scheme
Regulation 140(6) Maintain information required to be included in the remittance statement for at least 7 years after the date of the statement.
6. Others Regulation 54 - 56





Forward the following documents to employees within 7 working days of receiving them:
  • information about the scheme (including fees and charges) and the Constituent Funds
  • contact person designated by the Trustee and the means by which the person can be contacted
  • Membership Certificate
  • Members Benefit Statement
Regulation 143(2)(a)(b) Advise the Trustee within 30 days of any change of:
  • the employers business address, telephone number or facsimile number
  • the employees residential address, telephone number or date of payment of relevant income
Regulation 164(3) Provide the member a letter regarding termination of employment after the member becomes totally disabled.
